These Terms & Conditions ("Terms") apply to clinical, telehealth, wellness, functional medicine, and ancillary services (collectively, the "Services") provided by Optivita Health ("Clinic"). By scheduling, paying for, or receiving Services, you agree to these Terms in addition to any service-specific consent forms you sign.
The Clinic provides functional, integrative, and wellness-oriented medical care, including evaluation and management visits (in person and by telehealth), functional medicine assessment, laboratory ordering and interpretation, nutritional counseling, lifestyle medicine, hormone optimization where clinically appropriate, peptide and compounded therapy where clinically appropriate, IV and injectable therapies where offered, and related ancillary services. Liza Maria Rodriguez Jimenez, MD is the supervising physician. Not every Service is appropriate for every patient; clinical recommendations are made individually after evaluation.
The Clinic is physically located in Oregon. Liza Maria Rodriguez Jimenez, MD is licensed to practice medicine in 47 U.S. states. The Clinic does NOT provide care to patients physically located in New York, Pennsylvania, Massachusetts, West Virginia, and Rhode Island, and does not accept new patients who reside in or are physically located in those states at the time of service. You are responsible for being physically located in a state where the Clinic is authorized to provide care at the time of each visit. If you relocate or travel to a non-authorized state, you must notify the Clinic before your next visit; the Clinic may need to pause care until you are in an authorized location.

Medicine is not an exact science. The Clinic makes no warranty or guarantee that any Service, evaluation, supplement, peptide, medication, or other recommendation will produce a particular result, cure a condition, prevent disease, eliminate symptoms, or improve quality of life. Outcomes vary based on individual biology, adherence, comorbidities, environment, and many other factors.
Where clinically appropriate and after individualized informed consent, the Clinic may recommend FDA-approved medications for off-label uses or therapies that are prepared by a licensed compounding pharmacy. Such use is consistent with the practice of medicine. The Supplement/Peptide Informed Consent and applicable therapy-specific consents provide additional detail.
Routine communication with the Clinic should occur through the patient portal or by scheduled appointment. Email and text are not secure and are not used for urgent clinical issues. The Clinic does not provide 24/7 on-call services. For emergencies, call 911 or go to the nearest emergency department.
Either you or the Clinic may terminate the relationship at any time. The Clinic may discontinue care for reasons that include nonpayment, repeated missed appointments, threatening or abusive behavior, fraud, noncompliance with treatment recommendations that creates clinical risk, or relocation outside an authorized state. When the Clinic terminates the relationship, you will generally be given 30 days of emergency-only care to allow time to establish with a new provider, except where immediate termination is warranted.
Medical records are the property of the Clinic. You may request copies in accordance with HIPAA and Oregon law. A reasonable, cost-based fee may apply for copying or for completion of forms or letters that are not part of routine care.
Except for liability that cannot be limited by law (including liability for professional negligence to the extent prohibited by Oregon law), the Clinic's aggregate liability for any Service is limited to the amount you paid for that Service in the twelve months preceding the event giving rise to the claim. The Clinic is not liable for indirect, incidental, consequential, special, or punitive damages.
These Terms are governed by the laws of the State of Oregon. Any dispute will be brought exclusively in the state or federal courts located in Washington County, Oregon, except as required by state law for medical malpractice claims, which will be brought in the state where care was rendered.
These Terms, together with the Privacy Policy, HIPAA Notice of Privacy Practices, and any service-specific consent forms you sign, constitute the entire agreement between you and the Clinic regarding the Services.
